Garcia v. Character Technologies — wrongful-death suit
Filed October 22 2024 in the Middle District of Florida (case #6:24-cv-01903), the suit was brought by the family of Sewell Setzer III after his death by suicide following intense emotional and sexualized roleplay with a Character.AI character. In May 2025, Judge Anne Conway ruled — notably — that chatbot output may be treated as a *product* rather than protected speech, and Character.AI did NOT invoke Section 230. On January 7 2026, Conway issued a settlement order; the parties reached a mediated agreement in principle, with 90 days to finalize, and terms remain undisclosed. The Conway ruling has been read by other AI-chatbot defendants as a serious litigation precedent.

Character.AI itself banned under-18 open-ended chat
On October 29 2025, Character.AI announced — and on November 25 2025 made effective — a ban on open-ended chat for users under 18. This was Character.AI's own response to the cumulative product-safety pattern. If a company restricts its own product because the safety mechanisms can't be made adequate, that's the strongest signal you'll get about the underlying architecture.

Multiple family lawsuits and journalism investigations
Beyond Garcia, additional families have filed suit (Texas AG action December 2024, Social Media Victims Law Center actions, the Juliana Peralta case where suicidal ideation was reportedly disclosed 55 times to a Character.AI character before her November 2023 suicide). The Bureau of Investigative Journalism's October 2025 exposé documented an Epstein-bot scenario, and the December 2025 60 Minutes segment compiled the cumulative pattern.
